Terms of Use.
These terms apply to your use of aresiant.com (the "site"), operated by Aresiant Inc. ("Aresiant", "we", "us"), a company based in Toronto, Ontario, Canada. By using the site you agree to these terms. If you don't agree, please don't use the site.
1. Our services are covered by separate agreements
The site describes what we do. It is not an offer to provide services. Any work we do for you is governed by a separate written agreement, such as a proposal, statement of work or master services agreement. If those documents conflict with these terms, they take priority for the services they cover.
2. Information on the site
Content on the site is for general information only and is not legal, financial, tax or other professional advice. Examples, demos and figures, including the client portal demo and agent replays, use sample data for illustration and are not results promised for any particular business. Quotes are only binding once confirmed in writing.
3. Acceptable use
You agree not to:
- use the site in a way that breaks any law or infringes anyone's rights;
- attempt to gain unauthorized access to the site, its systems or areas that require a password;
- interfere with the site's operation, including by sending spam, malware or automated traffic intended to overload it;
- copy, scrape or reuse substantial parts of the site for a competing service.
4. Intellectual property
The site and its content, including text, design, films, animations, 3D renders, graphics, code and the Aresiant name and logo, are owned by Aresiant or its licensors and protected by intellectual property laws. You may view and share links to the site for personal or internal business purposes. Any other use requires our written permission.
Ownership of work we create for clients is set out in the client's agreement with us.
5. Messages you send us
When you contact us, you confirm the information is accurate and that you're allowed to share it. Don't send confidential information until we've agreed on how it will be protected, for example under an NDA. We handle personal information as described in our Privacy Policy.
6. Third-party links
The site may link to other websites. We are not responsible for their content, policies or practices.
7. Disclaimer
The site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we don't guarantee the site will be uninterrupted, error-free or always available.
8. Limitation of liability
To the fullest extent permitted by law, Aresiant will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of, or inability to use, the site. Nothing in these terms limits liability that cannot be limited by law.
9. Indemnity
You agree to indemnify Aresiant against claims, losses and costs arising from your misuse of the site or your breach of these terms.
10. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute about the site will be resolved by the courts located in Toronto, Ontario, unless the mandatory consumer protection laws of your country give you the right to bring proceedings where you live.
11. Changes
We may update these terms from time to time. The date at the top shows when they were last changed, and continued use of the site means you accept the updated terms.
